1. Service Provider Identification

2. Purpose

These conditions shall regulate the use that the Provider makes available to users of the Website, and with them it is intended to comply with the obligations set forth in Law 34/2002, on Information Society Services and Electronic Commerce (LSSI-CE), as well as to inform all users of the website regarding the conditions of use of the website.

Through the website, the Provider provides users with access to various contents, services, information and data (the "contents"), made available to users by the Provider or by third-party service and content providers.

Any person who accesses this website assumes the role of user, committing to the observance and strict compliance with the provisions set forth herein, as well as to any other legal provision that may be applicable, so that, if they do not agree with any of the conditions set forth herein, they must refrain from using this website.

The Provider reserves the right to modify any type of information that may appear on the website, without any obligation to give prior notice or inform users of such modifications, understanding as sufficient the publication on the Provider's website.

The use of certain services will also imply the acceptance, without any reservation, of the particular Conditions that the Provider may establish at any time with a specific, substitutive or complementary character to these General Terms of Use.

3. Service Description

DocuSapiens.ai is a documentation-as-a-service platform. The platform provides the following services:

  • Documentation site building and hosting: Users connect a GitHub repository containing markdown documentation. The platform builds a documentation website from the repository content and hosts it on a user-chosen subdomain.
  • AI-powered documentation search: The platform provides Retrieval-Augmented Generation (RAG) capabilities, allowing users and their visitors to query documentation using natural language. AI-generated responses are provided as a convenience and may contain inaccuracies. Users and visitors should not rely solely on AI-generated content for critical decisions.
  • Credit-based billing: The platform operates on a credit-based model. Users purchase credits to use certain platform features. Credits are consumed as services are used.

4. User Accounts and Authentication

To access the platform's services, users must create an account by authenticating through one of the supported OAuth providers (GitHub or Google). By creating an account, the user:

  • Authorises the platform to access their basic profile information (username, email address, name) from the chosen OAuth provider.
  • In the case of GitHub authentication, authorises the platform to access their repositories for the purpose of building documentation sites. A GitHub access token is stored to enable ongoing repository access.
  • Is responsible for maintaining the security of their connected third-party accounts. The Provider is not liable for unauthorised access resulting from compromised third-party credentials.
  • Agrees to provide accurate account information and to keep it up to date.

The Provider reserves the right to suspend or terminate user accounts that violate these terms or that remain inactive for an extended period, with reasonable prior notice.

5. Billing, Credits and Payments

The platform uses a credit-based billing system. The following terms apply:

  • Credit purchases: Credits are purchased through a secure checkout process powered by Stripe. All payment card details are processed exclusively by Stripe and are never stored on our servers.
  • Credit usage: Credits are consumed when using platform services such as building and hosting documentation sites. Current credit costs for each service are displayed on the platform.
  • Non-refundable: Purchased credits are non-refundable, except where required by applicable consumer protection legislation.
  • Pricing changes: The Provider reserves the right to change credit pricing at any time. Changes will not affect credits already purchased. Reasonable notice will be provided before any price changes take effect.
  • Transaction records: Users can view their transaction history, including credit purchases and usage, through the platform.

6. User Content and Repository Access

By connecting a repository to the platform, the user represents and warrants that:

  • They have the right and authority to grant the platform access to the repository and its content.
  • The documentation content does not infringe upon the intellectual property rights, privacy rights, or any other rights of third parties.
  • The content does not contain illegal, harmful, or objectionable material.

The user retains all ownership and intellectual property rights over their documentation content. The Provider does not claim any ownership over user-submitted content. The Provider is granted a limited licence to host, build, and serve the documentation content solely for the purpose of providing the service.

The Provider is not responsible for the accuracy, legality, or appropriateness of user-hosted documentation content. Users are solely responsible for the content they publish through the platform.

7. Liability

The Provider is exempt from any type of liability arising from information published on its website, provided that this information has been manipulated or introduced by a third party outside of it.

From the Provider's website it is possible to redirect to third-party website content. Since the Provider cannot always control the content introduced by third parties on their websites, it assumes no responsibility regarding such content. In any case, the Provider states that it will proceed to the immediate removal of any content that could contravene national or international legislation, morality or public order, proceeding to the immediate removal of the redirection to said website, bringing the content in question to the attention of the competent authorities.

The Provider is not responsible for the information and content stored, by way of example but not limitation, in forums, chats, blog generators, comments, social networks or any other means that allows third parties to publish content independently on the Provider's website. However, and in compliance with the provisions of articles 11 and 16 of the LSSI-CE, the Provider makes itself available to all users, authorities and security forces, and actively collaborates in the removal or, where appropriate, blocking of all those contents that could affect or contravene national or international legislation, third-party rights or morality and public order. In the event that the user considers that there is content on the website that could be susceptible to this classification, please notify the website administrator immediately.

This website has been reviewed and tested to function correctly. In principle, correct operation can be guaranteed 365 days a year, 24 hours a day. However, the Provider does not rule out the possibility that there may be certain programming and related errors, or that force majeure causes, natural disasters, strikes, or similar circumstances may occur that make access to the website impossible.

AI-generated content disclaimer: The platform provides AI-powered features, including natural language search and content retrieval. AI-generated responses are provided on an "as-is" basis and may be inaccurate, incomplete, or misleading. The Provider makes no warranties regarding the accuracy or reliability of AI-generated content. Users and visitors should verify AI-generated information against the original documentation sources.

Hosted documentation sites: The Provider hosts documentation sites built from user-provided repositories. The Provider is not responsible for the content, accuracy, or availability of these hosted sites. Users are solely responsible for the content they publish.

8. Intellectual and Industrial Property

The website, including by way of example but not limitation its programming, editing, compilation and other elements necessary for its operation, the designs, logos, text and/or graphics, is the property of the Provider or, where appropriate, has a license or express authorization from the authors. All website content is duly protected by intellectual and industrial property regulations, as well as registered in the corresponding public registries.

Regardless of the purpose for which they were intended, total or partial reproduction, use, exploitation, distribution and commercialization, requires in all cases prior written authorization from the Provider. Any use not previously authorized by the Provider will be considered a serious breach of the author's intellectual or industrial property rights.

The designs, logos, text and/or graphics not belonging to the Provider and that may appear on the website, belong to their respective owners, being themselves responsible for any possible controversy that may arise regarding them. In any case, the Provider has express and prior authorization from them.

The Provider recognizes in favor of its holders the corresponding industrial and intellectual property rights, not implying their mere mention or appearance on the website the existence of rights or any responsibility of the Provider over them, nor endorsement, sponsorship or recommendation by it.

To make any type of observation regarding possible breaches of intellectual or industrial property rights, as well as about any of the website content, you can do so by sending a written communication to the tax address or email address that appear at the beginning of this document in the section Service Provider Identification.

9. Access and Use Conditions

Access to the landing page and general information about the platform is free and does not require registration. However, to use the platform's services (building, hosting, and querying documentation sites), users must create an account via GitHub or Google OAuth as described in Section 4.

The User undertakes to make adequate and lawful use of the website as well as the contents, products and services, in accordance with the applicable legislation at all times, these General Terms of Use of the website, morality and generally accepted good customs and public order.

The User must refrain from:

  • Making unauthorized or fraudulent use of the website and/or contents for illicit purposes or effects, prohibited in these Conditions, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload, deteriorate or prevent the normal use of services, computer equipment or documents, files and all kinds of content stored on any computer equipment.
  • Accessing or attempting to access restricted resources or areas of the website, without meeting the conditions required for such access.
  • Causing damage to the physical or logical systems of the website, its suppliers or third parties.
  • Introducing or spreading computer viruses or any other physical or logical systems on the network that are likely to cause damage to the physical or logical systems of the PROVIDER, its suppliers or third parties.
  • Attempting to access, use and/or manipulate the data of the PROVIDER, third-party providers and other Users.
  • Reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the contents, unless authorized by the holder of the corresponding rights or legally permitted.
  • Deleting, hiding or manipulating notes on intellectual or industrial property rights and other identifying data of the rights of THE PROVIDER or third parties incorporated into the contents, as well as technical protection devices or any information mechanisms that may be inserted into the contents.
  • Obtaining and attempting to obtain the contents using means or procedures other than those that, depending on the case, have been made available for this purpose or have been expressly indicated on the web pages where the contents are found or, in general, those commonly used on the Internet as they do not entail a risk of damage or disabling of the website and/or contents.
  • Hosting documentation that contains illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable content through the platform.
  • Connecting repositories to which the user does not have the right or authority to grant access.
  • Using the platform to host content unrelated to documentation purposes.
  • Attempting to circumvent the credit-based billing system or abuse platform resources.

In particular, and merely by way of indication and not exhaustively, the User undertakes not to transmit, disseminate or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of material that:

a) In any way, is contrary to, belittles or attacks the fundamental rights and public freedoms constitutionally recognized, in international Treaties and in the rest of the legislation.

b) Induces, incites or promotes criminal, denigratory, defamatory, infamous, violent actions or, in general, contrary to law, morality and generally accepted good customs or public order.

c) Induces, incites or promotes discriminatory actions, attitudes or thoughts based on sex, race, religion, beliefs, age or condition.

d) Incorporates, makes available or allows access to criminal, violent, offensive, harmful, degrading products, elements, messages and/or services or, in general, contrary to law, morality and generally accepted good customs or public order.

e) Induces or may induce an unacceptable state of anxiety or fear.

f) Induces or incites involvement in dangerous, risky or harmful practices for health and psychological balance.

10. Modification and Termination of Services

Although, in principle, the duration of this website is indefinite, the Provider reserves the right to modify, suspend or terminate the provision of its services, in whole or in part, at any time, and without the need for prior notice to its Users.

In the event of service termination, the Provider will make reasonable efforts to provide users with advance notice and the opportunity to export their data.

Likewise, the Provider may modify the Terms of Use of this website at any time.

11. Applicable Legislation and Jurisdiction

These General Conditions are subject to Spanish legal system, submitting any controversy to the courts and tribunals corresponding to the city of Ourense, except in cases where the forum corresponds to the consumer's domicile.
